Notice of Public Hearing – Official Community Plan Amendment Bylaw No. 3221, 2021 and Zoning Amendment Bylaw No. 3166.02, 2021

Notice is hereby given by the City of Duncan that a Public Hearing will be held on Monday, November 1, 2021, at 5:00 p.m. to consider Official Community Plan Amendment Bylaw No. 3221, 2021, and Zoning Amendment Bylaw No. 3166.02, 2021. This Public Hearing will be conducted by electronic means due to the COVID-19 pandemic. Persons who believe their interest is affected by the proposed bylaws may participate by electronic means, in-person or submit written comments.

Purpose

Official Community Plan (OCP) Amendment Bylaw No. 3221, 2021

The purpose of proposed OCP Amendment Bylaw No. 3221, 2021 is to amend Official Community Plan Bylaw No. 2030, 2007 Temporary Use Permit Policies (Section 6.4.2) to replace “emergency shelter, as defined in the Zoning Bylaw” with “temporary accommodation or shelters in any area of the City”. The requirements for public notice and consultation for Temporary Use Permits is not being altered.

Zoning Amendment Bylaw No. 3166.02, 2021

The purpose of the Zoning Amendment Bylaw No. 3166.02, 2021 is to amend Zoning Bylaw No. 3166, 2017 by introducing new regulations for the first storey of mixed-use developments in the Downtown Comprehensive and Neighbourhood Commercial Zones.

How do I get more information?

The proposed bylaws and staff report can be viewed on the City’s website at www.duncan.ca or at City Hall, 200 Craig Street, Duncan, BC, Monday to Friday, between 8:30 a.m. and 4:00 p.m. (except public holidays), and from the date of publication of this notice until 4:00 p.m. on the date of the Public Hearing.

How do I participate?

There are three ways to participate in the public hearing; written submission, in-person, or virtual participation.

Due to COVID-19 Public Health Orders, in-person attendance is limited. City meetings have been held electronically on the Zoom meeting platform.  Registration is required to speak to the bylaw amendments, or to attend in-person at City Hall.  It is recommended that you register several days in advance.  The City of Duncan Public Hearings are public and will be televised, streamed live, recorded, and archived on the City’s website for public viewing anytime.  By registering, you are consenting to your personal information being disclosed and accessible outside of Canada by virtue of webcasting and archiving on the City’s website.

Prior to the Public Hearing, all submissions received by Noon, Wednesday, October 27, 2021, will be placed in the Council agenda package. Please include your name and address in your submission.  Written submissions received after this date will be accepted up until the end of the Public Hearing and will be provided to Council.  All submissions will form part of the Public Hearing record.  Personal information is protected under the Freedom of Information and Protection of Privacy Act, and will be redacted, if required, before being published.

Further Information:

Please note, the Public Hearing is not a question-and-answer session.  The purpose of a Public Hearing is for the members of the public to state their opinions on the proposed bylaw(s). Decisions concerning the adoption of the proposed bylaw(s) will not be made until the record of Public Hearing is received and considered by the City of Duncan Council. Please be advised that the City of Duncan Council cannot receive public submissions following the close of the Public Hearing.
